1. Introduction

Welcome to DUDECLUB ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the DUDECLUB website, mobile application, and services (collectively, the "Services"), including the purchase of our kratom drinks.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Age Restrictions

In accordance with Thailand's Kratom Plant Act B.E. 2565, our Services and products are strictly available only to individuals who are 18 years of age or older. By using our Services, you represent and warrant that you are at least 18 years old. We reserve the right to request proof of age at any point and to refuse service if adequate proof is not provided.

3. Account Registration

To access certain features of our Services, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Ordering and Payment

When placing an order through our Services, you agree to provide current, complete, and accurate purchase and account information. All payments must be made in Thai Baht (THB). We accept various payment methods as indicated on our checkout page.

We reserve the right to refuse or cancel your order if we suspect fraud, unauthorized or illegal activity, or if products are mispriced due to system errors.

5. Delivery and Pickup

We offer delivery within specified areas in Thailand and pickup options at our designated locations. Delivery times are estimates and not guaranteed. Additional delivery fees may apply based on your location and order size.

For pickup orders, you must present a valid ID proving you are at least 18 years old when collecting your order.

6. Refunds and Returns

Due to the nature of our products, we generally do not accept returns. However, if you receive damaged or incorrect products, please contact us within 24 hours of receipt. We may offer replacements or refunds at our discretion.

7. Product Information

We strive to provide accurate product information, including ingredients and mitragynine content. However, we do not warrant that product descriptions or other content on our Services are accurate, complete, reliable, current, or error-free.

All kratom products contain less than 1 mg/day of mitragynine as per Thai FDA guidelines. Our products are intended for refreshment purposes only and not for medicinal use.

8. Intellectual Property

All content on our Services, including text, graphics, logos, images, and software, is the property of DUDECLUB or our licensors and is protected by Thai and international copyright, trademark, and other intellectual property laws.

9. User Conduct

You agree not to use our Services to:

  • Violate any applicable laws or regulations
  • Infringe the rights of others
  • Attempt to gain unauthorized access to our Services or systems
  • Engage in any activity that interferes with or disrupts our Services
  • Resell our products without authorization

10. Limitation of Liability

To the maximum extent permitted by law, DUDECLUB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Services.

11. Disclaimers

Our Services and products are provided "as is" without any warranties, expressed or implied. We do not make any health claims regarding our kratom products. Consumers should use our products responsibly and be aware of potential effects.

Pregnant or nursing women should consult with a healthcare professional before consuming kratom products.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts of Thailand.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
